1. The agreement
These terms are an agreement between [Company legal name, e.g. WaiterSkip s. r. o.] (“WaiterSkip”, “we”) and the business that creates a WaiterSkip account (“you”). By creating an account you accept them and confirm that you may act for that business. Our privacy policy explains how we handle personal data.
2. Business use only
WaiterSkip is a tool for restaurants, cafés, bars and similar businesses. It is not offered to consumers. Your guests use the ordering pages without an account and are not a party to these terms.
3. The service
WaiterSkip lets your guests scan a table’s QR code, enter the table PIN, browse your menu, order and request the bill from their phone, and lets your staff see and handle orders live on a dashboard. You manage your menu, tables and staff yourself. Which limits and features apply depends on your plan, as shown on the pricing page and in the app.
We keep improving the service and may change features. We won’t materially reduce the core features of your paid plan during a period you have already paid for.
4. Accounts and staff
- Give accurate information and keep it up to date, including an email address you can receive password-reset links at.
- Keep sign-in details secret. Each staff account is for one person.
- You’re responsible for the staff accounts you create and what they do; remove access when someone leaves.
- Tell us at [Contact email, e.g. hello@waiterskip.com] if you suspect someone has accessed your account without permission.
5. Free trial
New accounts get a 30-day free trial on the Starter plan, without a card. When the trial ends, the dashboard pauses and guests can’t start new orders until you choose a paid plan. If you choose a plan during the trial, your card is saved and first charged when the trial ends (or right away if less than two days of the trial are left). Upgrading in the billing portal during the trial (to a bigger plan, or from monthly to yearly billing) ends the trial and starts paid billing straight away; a move to a smaller plan takes effect when the trial ends.
6. Plans, billing and cancellation
- Paid plans are billed monthly or yearly in advance, in euros, through our payment provider Stripe. Prices are shown on the pricing page and in the app [state whether prices include VAT].
- Subscriptions renew automatically at the end of each billing period (month or year) until cancelled.
- Each plan includes a number of restaurants, tables, menu items and staff accounts, shown on the pricing page. Upgrades apply straight away and you pay the prorated difference; downgrades take effect at the end of the current billing period. After a downgrade, what you already have keeps working, but you can’t add more until you’re within the lower plan’s limits.
- You can change plan, update your card, see invoices or cancel at any time under Billing → Manage subscription. A cancellation takes effect at the end of the period you’ve paid for; you keep access until then.
- Fees already paid are not refunded, except where the law requires it [confirm refund policy].
- If a payment fails, the account is marked past due: the dashboard pauses and guests can’t start new orders until the payment succeeds. You can update your card in the billing portal.
- We’ll give at least 30 days’ notice by email of a price change. It applies from your next billing period, and you can cancel before then.
7. Your responsibilities
- Your menu: you’re responsible for items, prices, descriptions, photos, and for allergen and other food information required by law (for example EU Regulation 1169/2011).
- Orders and service: WaiterSkip passes orders to your staff; preparing, serving and resolving problems with orders is up to you.
- Payments and receipts: guests pay you directly, outside WaiterSkip. WaiterSkip is not a cash register or fiscal device, and the order summary guests see is not a tax receipt. You remain responsible for issuing receipts and meeting your tax and fiscal obligations (for example eKasa in Slovakia).
- Table PINs and QR codes: keep PINs for the guests at the table and change them if they leak.
- Your guests’ data: you’re responsible for telling your guests how their orders are handled (see section 9).
8. Acceptable use
Don’t:
- try to access other businesses’ data, test or bypass our security, or interfere with the service;
- overload the service or use automated means beyond normal use of the app;
- upload unlawful content or content you don’t have the rights to (such as menu photos);
- resell or white-label the service without our written agreement, or copy or reverse-engineer it except as the law allows.
9. Your content and data
Your menu, photos, business information and order history stay yours. You allow us to store, process and display them only to provide the service to you, your staff and your guests.
For guests’ orders we act as your processor under Art. 28 GDPR: we process them only on your instructions, to run the service, and under the data-processing terms in [Data Processing Addendum — to be prepared and linked here]. For your own account data we are the controller, as described in the privacy policy.
10. Our rights
The WaiterSkip software, design and brand belong to us or our licensors. You get a right to use the service for your business for as long as your account is active. If you send us feedback, we may use it without obligation to you.
11. Availability and support
We aim to keep WaiterSkip available at all times but can’t guarantee uninterrupted service — for example during maintenance or problems outside our control. 12. Suspension and termination
- You can stop using WaiterSkip at any time by cancelling your subscription, or close your account entirely under Account → Close account. Closing ends the subscription immediately (the rest of the paid period isn’t refunded), signs everyone out, and deletes the account’s data after 30 days.
- We may suspend or close an account for a serious or repeated breach of these terms, non-payment, or when the law requires it — with notice where reasonable.
- After an account is closed you can ask us to restore it, or for an export of your data, within 30 days; after that we delete it as described in the privacy policy.
13. Liability
Nothing in these terms limits liability that can’t be limited by law, such as for intent or gross negligence. Otherwise:
- we’re not liable for indirect or consequential losses, such as lost profits, revenue or goodwill;
- our total liability in any 12 months is limited to the fees you paid us in those 12 months [confirm cap];
- you’re responsible for claims arising from your menu content, your service to guests and your use of the service against these terms.
14. Changes to these terms
We may update these terms. For important changes we’ll email account owners at least 30 days before they take effect; if you don’t agree, you can cancel before then. Continuing to use WaiterSkip after that means you accept the new terms.
15. Governing law and disputes
These terms are governed by [Governing law, e.g. the laws of the Slovak Republic]. Disputes go to [Competent courts, e.g. the courts of the Slovak Republic with jurisdiction over our registered office].
